About What's Up! Luxembourg

What's Up! Luxembourg is a service designed for people to mark, discover and share points of interests around Luxembourg.

By choosing to use the services provided by What's Up! Luxembourg and related applications to it, the user is subject to the terms of agreement stated below. Therefore, if you use this service (i.e. the What's Up! Luxembourg software), you are expected to have read this document and accepted it. We reserve the right to amend this agreement at any time, so please check back regularly by accessing this document from the application's menu system or on the What's Up! Luxembourg website. Your continued use of our services constitutes your acceptance of our amended terms and policies. What's Up! Luxembourg is operated by NeatCapital OÜ, and is not affiliated with the government.

Terms of Agreement

Privacy

A fundamental goal of What's Up! Luxembourg is to provide its users information about their community, but at the same time respect their privacy. Therefore, as long as the user is only observing content, it never asks them to enter any information that would be used by the creators of the system to identify them in real life. Users should however note that since the service provides access to external websites, those websites can ask for personal information or gather information without respecting users' privacy. What's Up! Luxembourg is not responsible for the behavior of any external website accessed within the software. The creators and the community however, carefully monitor external content referenced via the service. We will try to inspect and if necessary, take down references to such sources if they are reported to us. If you see something suspicious or unpleasant, please let us know.

What's Up! Luxembourg collects certain data about how users consume contents provided by its services, and also basic information about devices that are used to access its services. Such data includes the operating system type, the operating system version, the application version, certain device IDs and so on. This information is primarily gathered to perform analysis of how the services are used, and which areas should the creators focus on to improve the quality of the service. The gathered data can also be used to identify any misuse of the service, and block malicious actions. By using the provided services by this application, you agree to share this data with the service provider. Moreover, such data is used to provide a personalized user interface, for example by showing indicators when the user has rated some content, or showing the comments written by the user.

Additional third party software libraries such as Google Maps and related services, as well as Firebase and Facebook SDKs are also integrated into this application which may collect additional data. By using this software you also give consent for the data collected by those services. We use such services to improve the quality of the application (e.g. by collecting aggregate usage data), send remote notifications and ease the communication between the client and server portions of this application.

When you use the application, the location services of your device may allow the application to know about your location. Such services are used to be able to show your location on the map, and tell you how far you are to a specific event in your area. The coordinates the map show the user are transmitted to the server to query entries around that region.

What's Up! Luxembourg may provide access and tools to certain users to add content into its system. In case you add content covered by intellectual property (IP) rights, such as photos or text, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any content posted by you to our system.

When you delete content originally posted by you, the content will be rendered unavailable and inaccessible to the general users of the service, and will then at some point be deleted from our database (similar to emptying the recycle bin on a computer). However, you understand that the removed content may persist in backup copies for a reasonable period of time. Unpredictable glitches in the software may make the deletion action fail. In such cases, you can contact us to manually remove your content.

Safety

We do our best to keep the services safe, but we cannot guarantee it. By using our services, you accept that the service providers are in no way responsible for the third party content. We need your help to keep the services safe, which includes the following commitments by you:

  • You will not use this application if you are below 18 years of age.
  • You will not use our services to engage in any unlawful, misleading or discriminatory activity.
  • You will not upload malicious information.
  • You will not bully, intimidate or harass any user, nor will you post content that is hate speech, threatening or pornographic, incites violence, or contains nudity or graphic of gratuitous violence.
  • You will not do anything that could disable or impair the functionality of our services, such as a denial of service attack or any other computer based attacks on our services.
  • You will not post material that you are not authorized to share, such as copyrighted content.

User Account Security

The service assigns unique identification codes to each installed instance of the application. As long as the user does not wish to post any content to the system (i.e. events, posts, comments, messages or similar forms of content), the service does not ask the user to provide any more personal information. These codes are used to deliver notifications to users, as well as track up/down votes and visits of contents.

Users may be allowed to create accounts which could allow them to add POIs, events, posts, media, comments, and similar forms of content to the system. To create a user account, users may opt out of providing their real name, age, or other information. They can merely supply an alias, which can be freely chosen based on their availability and rules defined in the system.

Users may be allowed to communicate with each other using services provided by the system. We advise them to be careful when sharing any private information. You are responsible for the information you share via this service and its consequences.

We reserve the right to block or terminate any account at any time. Also, you can delete your user account from within the application, which deletes all your shared information as described in section 1 of this document.

Disputes

We try to keep the services functional and safe. However, the services are provided AS-IS, and the creator of What's Up! Luxembourg and parties involved in providing services through its system are not liable for any damages or harm that may have been caused by using the services. IF YOU FIND THE USE OF THIS SERVICE IN ANY ASPECT POTENTIALLY HARMFUL TO YOU, YOU SHOULD IMMEDIATELY STOP USING IT AND REMOVE THE SOFTWARE FROM YOUR MACHINE(S). IN CASE OF A DISPUTE, YOU ACKNOWLEDGE AND ACCEPT THAT THE MAXIMUM TOTAL LIABILITY BY THE CREATOR OF THIS APPLICATION DOES NOT EXCEED 2 (TWO) EUROS IN CASE OF ANY DISPUTES. Moreover, you agree that we are not liable for inaccurate or wrong information regarding events or posts on the system. You also agree that we may change the terms of use at any time and without any notice. Therefore, you agree that you would check it frequently by accessing it from the application menu, and would not continue using the application in case you have any issues with that.

In case you spot content that is inaccurate, misleading, or infringing on the rights of other persons, or if you have other issues with the system, we appreciate if you contact us by email at contact@neatcapital.ee.

Collaboration

The goal of this service is to create a unified place for creation, discovery and sharing of POIs. If you are a local business owner, a media person or an investor, we ask you to collaborate with us in order to be able to make a rich platform for this community. Support

This service is provided to you AS-IS. The services may be unavailable from time to time, or not work as expected. While we will work to provide the best experience possible, there is no guarantees that the service would be available at all times. Please bear with us during the down-times and glitches!
